MEETING NOTICE – ESPERANCE NYUNGAR PEOPLE AUTHORISATION MEETING
DATE: 14 February 2020
TIME: 10am until 14:00pm
VENUE: Esperance Civic Centre, Council Place Esperance
PURPOSE OF THE MEETING
To discuss, consider and make decisions about:
1. Authorising a new native title claim in the Federal Court of Australia over the area shown in the map below;
2. Authorising a number of Esperance Nyungar People, as Applicants, to bring the proposed claim and to determine the limits of the Applicant's authority, if any; and
3. Native Title Services Goldfields (NTSG) representing the Esperance Nyungar People in the proposed Esperance Nyungar Sea & Islands native title claim.

PEOPLE INVITED TO ATTEND THE MEETING
The Esperance Nyungar People are:
1. Those Aboriginal people who are:
(a) The descendants (meaning those persons who are the biological descendants of the named ancestors listed at I to VII, or who are adopted in accordance with Esperance Nyungar traditional laws and customs) of:
I. Sambo = Weegie (aka Durdap) of Esperance;
II. Maggie Munroe (nee Bland) of Esperance;
III. Charlie Nine of Thomas River;
IV. Wynbert of Bandy Creek;
V. Jack Boxer = Mary of Esperance;
VI. White Ann (aka Anna Whitehand or Ponton) of Thomas River;
VII. Maggie of Thomas River (including the descendants of Yorkshire Bob = Bessie Bevan); and
(b) Jean McKenzie who has historical and cultural connections to country included in the Esperance Nyungar determination area;
AND
2. who identify themselves as Esperance Nyungars under the traditional laws and customs of the Esperance Nyungars and are so identified by other Native Title Holders as Esperance Nyungars;
AND
3. who have a connection with the land and waters in the Esperance Nyungar determination area, in accordance with the traditional laws acknowledged and the traditional customs observed by the Esperance Nyungars.
AGENDA
The following matters are to be discussed at the meeting:
1. Background
- NTSG is calling a meeting to discuss and authorise a new native title claim over the area shown in the above map, including over Powell Point, Termination Island, Mondrain Island, Middle Island, Salisbury Island, Point Malcolm and Point Dempster. This meeting is called an 'Authorisation Meeting'.
- Before a new native title claim is filed in the Federal Court of Australia, those people who hold native title rights and interests over the proposed claim area must 'authorise' one or more members of the native title claim group to make the claim and deal with matters arising in relation to it. These people are called the Applicant. The Applicant is authorised by the group to make decisions about how the claim will be run. The claim group may want to limit the power of the Applicant to make certain decisions.
2. Authorisation to bring the new native title claim
- Claim group description – the meeting will be asked to consider and make decisions about whether the claim group (who will be included on the new claim) should be described in accordance with the proposed claim group above. The proposed claim group may be amended at the meeting as a result of discussion at the meeting.
- Applicant – the meeting will be asked to make a decision choosing the people who will together be the Applicant for any new claim. The meeting will also be asked to authorise those people to make the native title claim on behalf of all the people in the claim group, and to deal with matters arising in relation to the claim.
- Limits on Applicant's authority to act – The meeting will be asked to consider whether there should be any limits on the Applicant's authority to Act. This might include the authority to make certain decisions or whether certain decisions must be made by the whole claim group. It may also include whether any decision of the Applicant can be made by majority or whether it must be unanimous.
- Claim name – the Authorisation Meeting will be asked to select a name for the new claim.
3. Other Business
TRAVEL ASSISTANCE
A contribution of up to $300 will be paid to members of the claim group who attend the meeting from elsewhere. The maximum travel allowance will only be paid to those people who attend the meeting from a distance further than 500kms. All other attendees will be paid a pro-rata amount that will be displayed at the meeting.
Travel allowance is paid per vehicle and to claim the travel allowance you will need to be present for the entire meeting and NTSG staff may ask to see your driver's licence, your vehicle registration or the vehicle itself.
Travel allowance will only be paid from NTSG's bank account at the end of the day's meeting.
NTSG reserves the right to vary the amount of travel allowance, at its absolute discretion
